Mendip Creative – Terms & Conditions

These Terms & Conditions (“Terms”) apply to all services provided by Mendip Creative, operated by Simon Biddlecombe, based in Radstock, UK. By commissioning work, the Client agrees to these Terms.

1. Services Provided

Mendip Creative provides web design, branding, digital content creation, hosting setup, maintenance, and related creative services. All work is carried out based on the agreed project scope, proposal, or written communication.

2. Payments & Deposits

  • A deposit may be required before work begins.

  • Remaining balances must be paid upon project completion or as otherwise agreed.

  • Late payments may delay delivery or suspend services.

  • All prices are quoted in GBP unless stated otherwise.

3. Revisions & Additional Work

  • Projects include a reasonable number of revisions as agreed.

  • Additional revisions, new features, or changes outside the original scope will be charged at Mendip Creative’s standard hourly rate.

4. Client Responsibilitie

The Client agrees to:

  • Provide all required content, images, branding, and information in a timely manner.

  • Ensure they have the legal right to use any materials supplied.

  • Review and approve work promptly to avoid delays.

Mendip Creative is not responsible for delays caused by missing content or slow communication.

5. Website Hosting, Software & Third‑Party Services
Where hosting, plugins, themes, or third‑party services are used:

  • Mendip Creative does not own or control third‑party platforms.

  • The Client is responsible for ongoing subscription fees, renewals, and compatibility.

  • Software updates, plugin updates, and server changes may affect website functionality.

6. Liability & Disclaimer


6.1 No Liability for Software Breakages

Mendip Creative is not responsible or liable for:

  • software bugs

  • plugin/theme conflicts

  • CMS updates

  • server changes

  • third‑party service failures

  • database corruption

  • accidental data loss

6.2 No Liability for Hacking or Security Breaches

Mendip Creative accepts no responsibility for:

  • hacking

  • malware

  • unauthorised access

  • security breaches

  • compromised accounts

  • data theft

Security is a shared responsibility between the Client, hosting provider, and any third‑party services used.

6.3 No Liability for Downtime or Loss of Earnings

Mendip Creative is not liable for:

  • website downtime

  • hosting outages

  • email failures

  • loss of traffic

  • loss of revenue

  • loss of business

  • consequential or indirect damages

6.4 Maximum Liability

If Mendip Creative is found liable for any reason, liability is strictly limited to the total amount paid by the Client for the specific project.

7. Intellectual Property

  • Mendip Creative retains ownership of all design concepts, code, and materials until full payment is received.

  • After payment, ownership of the final deliverables transfers to the Client, excluding any third‑party assets or licensed components.

  • Mendip Creative may display completed work in portfolios or marketing materials unless the Client requests otherwise.

8. Ongoing Maintenance

If the Client does not have a maintenance agreement:

  • Mendip Creative is not responsible for updates, backups, security, or ongoing support.

  • Any fixes or updates requested will be charged at the standard hourly rate.

9. Termination

Either party may terminate the project with written notice. The Client must pay for all work completed up to the termination date.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be handled in UK courts.
